Red Kite.
MOD have said that they will not object so long as Enertrag can first develop, then prove (prior to any construction) that they have a mitigation technology that will reduce the effect on the RAF Watchman Radar system to an extent that will not effect Waddington, Coningsby and Cranwell. MOD Estates have added that they do not believe this will be attained by Enertrag and have given them the period of the planning consent (if the inspector approves the application after the conclusion of the appeal) namely within 3 years.
So we find ourselves in the curious position that Enertrag has dragged everyone to appeal (at a massive cost of around 80k Pounds to ELDC tax payers and 35k Pounds to BWAG) based on a mitigation measure that was promised but strangely missing from their original planning response. ELDC is now fighting in part this "non determination" accusation from Enertrag based on Enertrag mitigation data they did not have and could not produce.
Even if Enertrag wins this weak appeal case the inspector can decide to either enforce or ignore the conditions set by MOD. So it appears that we are not out of the woods on that one.
Effectively The MOD has called Enertrag's bluff to put up or shut up but not stated outright they object irrespective of any mitigation measures.
